Introduction

MuseKat, Inc. ("Company," "we," "us," or "our") wants you to be familiar with how we collect, use, and share information about you. This Privacy Policy ("Privacy Policy") describes with the types of information that we collect, use and share about you when you visit or use:

Collectively, we refer to the foregoing as the "Services." The terms "you" and "your" refers to you, the user. If you are using the Services on behalf of a business, association, or other entity, "you" or "your" will also refer to such business, association, or other entity, unless the context clearly dictates otherwise. You agree that you are authorized to consent to these terms on behalf of such business, association, or other entity, and we can rely on this. This Privacy Policy also explains how Company may use and share your Personal Information (as defined in Section 1), as well as the choices available to you.

By using/continuing to use the Services, you acknowledge you have read and understand and agree to the collection, storage, use, and disclosure of your Personal Information as described in this Privacy Policy, and you agree to the Terms of Service which is incorporated by reference. If you do not agree, please do not access or use the Services.

Eligibility to Use the Services

To use the Services you must be, and represent and warrant that you are, at least the age of majority in your state, province or jurisdiction of residence and competent to agree to these terms; or if you are under the age of majority in your state, province or jurisdiction of residence, you represent and warrant that your parent or legal guardian has reviewed this Privacy Policy with you and accepts them on your behalf; parents or legal guardians are responsible for the activities of their minor dependents while using the Services.

Terms of Service

If you choose to access or use the Services, your access and use, and any dispute over privacy is subject to this Privacy Policy and our Terms of Service, including, but not limited to, limitations on damages and resolution of disputes. Where you upload and choose to share personal information about yourself, you are explicitly consenting to our sharing/making it public to other members of the Services.

Personal Information We Collect

Generally, we collect four (4) types of information about you: (A) information and content you give us directly; (B) information we obtain automatically when you use our Services; (C) demographic information; and (D) information we get about you from other sources. When we talk about "Personal Information" in this Privacy Policy, we are talking about information that can be used on its own or with other information to identify you as an individual or relates to an identifiable individual that is collected in accordance with this Section. Demographic Information

We may collect demographic, statistical, or other aggregate information that is about you, but individually does not identify you. Some of this information may be derived from Personal Information, but it is not Personal Information and cannot be tied back to you. Examples of such aggregate information include gender, age, and race.

Information We Get About You From Other Sources

We may receive information about you from other sources, such as publicly available databases, and add it to our information, including from third-party services and organizations who have the right to provide us with such information. For example, if the Services contain functionality and/or features that allow you to connect your social media account to your Services account, you will share certain Personal Information from your social media account with us, including your name, email address, photo, connections, and any other information that may be accessible to us when you connect your accounts. We protect this information according to the practices described in this Privacy Policy, plus any additional restrictions imposed by the source of the data. These sources may include: online and offline data providers, from which we obtain demographic, interest-based, and online advertising related data; publicly-available sources such as open government databases or social networks; and service providers who provide us with information, and updates to that information, based on their relationship with you. Note on Sensitive Information

Unless we specifically request it, we ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, or criminal background) on or through the Services or otherwise to us.

Third-Party Technologies

This Privacy Policy covers the use of cookies by Company and does not cover the use of tracking technologies by any third parties. The Services may contain links, content, advertising, or references to other websites or applications run by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies or other tracking technologies to collect information about you when you interact with their content on the Services, such as member recruitment vendors to using Web beacons and cookies on our registration pages for payment verification. The information they collect may be associated with your Personal Information or they may collect information about your online activities over time and across different websites. Please be aware that we do not control these third parties' tracking technologies or when and how they may be used. Therefore, Company does not claim nor accept responsibility for any privacy policies, practices, or procedures of any such third party. Device Location Functionality

We may collect the approximate physical location of your device by, for example, using satellite, cell phone tower, Wi-Fi signals, or user inputs to MuseKat. We may use your device's physical location to provide you with personalized location-based services and content. In some instances, you may be permitted to allow or deny such use of your device's location, but, if you do, we may not be able to provide you with the applicable personalized services and content.

Analytics

We use analytics services, such as Google Analytics, which use cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. These services may also collect information regarding the use of other websites, apps, and online services. Generative AI

We may use third-party artificial intelligence (AI) application programming interfaces (APIs) to enhance the functionality of the Services, including features such as content generation, personalization, and user interaction. These AI APIs may process user inputs to generate responses or recommendations but do not store Personal Information beyond the duration required for processing. To protect user privacy, any data sent to AI APIs is either anonymized or processed in a way that prevents direct identification. AI API providers have their own privacy policies governing how they process data. Users can review these policies to understand how their data may be handled. Where applicable, users may have the ability to limit or disable AI-driven features within Company's settings, though this may impact certain functionalities.

Your Right to Appeal

If you are dissatisfied with the refusal of Company to take action in accordance with the exercise of your rights in the "Accessing and Correcting Your Information" section above, you may request reconsideration by Company, by sending a written request for reconsideration to the mailing address found in the "Contact Information" section below. Within sixty (60) days of Company's receipt of such written request for reconsideration, Company shall inform you in writing (at the address indicated in your initial written request) of any action taken or not taken in response to your request for reconsideration, including a written explanation of the reasons for the decision. How We Protect Your Personal Information

We have implemented safeguards reasonably designed to secure your Personal Information. Such safeguards include the implementation of various technical, physical, administrative and organizational security measures intended to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your information. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information is also dependent on you. If we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Personal Information Retention Period

We keep your Personal Information for the length of time needed to carry out the purpose outlined in this Privacy Policy and to adhere to our policies on keeping records (unless a longer period is needed by law). Our records policies reflect applicable laws. We will retain and use your Personal Information to the extent necessary to manage your relationship with us, personalize and improve your overall customer experience, and to comply with our legal obligations. For clarity, without limiting the generality of the foregoing, we are not responsible for the information collection, use, disclosure, or security policies or practices of other third-party organizations, such as Facebook, Twitter, Instagram, YouTube, Pinterest, LinkedIn, Apple, Google, Microsoft, RIM, or any other app developer, app provider, social media platform, operating system provider, wireless service provider, or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with our Services or social media pages.

Children's Privacy Notice

We are especially committed to protecting the privacy of children. While the Services are designed for a general audience over the age of eighteen (18), Company does allow the use of the Services by children under eighteen (18) years of age ("Child" or "Children"), but only with the consent and supervision of the Child's parent or guardian after the parent or guardian has set up a Services account and provided verifiable parental consent. For clarity, Children do not create their own Services accounts.

We respect all of our users' privacy, but we recognize the need to provide additional privacy protections with respect to the Personal Information we collect from Children pursuant to the United States' Children's Online Privacy Protection Act of 1998 ("COPPA"). Accordingly, Company handles Children's privacy through the following controls:

Jurisdiction and Cross-border Transfer

We are located in the United States. We may store and process your Personal Information in any country where we have facilities or in which we engage service providers. If you provide Personal Information through the Services, you acknowledge and agree that your Personal Information may be transferred from your current location to the offices and servers of Company and other third parties referenced in this Privacy Policy located in the United States and other countries outside of your country of residence, which may have data protection rules that are different from the laws of the country where you live. We endeavor to safeguard your information consistent with the requirements of such laws, where applicable.

Updates to this Privacy Policy

The "Last Updated" legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. We reserve the right to update this Privacy Policy from time to time in order to reflect, changes to our practices or for other operational, legal, or regulatory reasons. When we do update this Privacy Policy, we will post the updates and changes on our website. We may elect to notify you of material changes by mail, email, posting of modified Privacy Policy, or some other similar manner.
